Unfinished Business in the 108th Congress

108th Congress left much work undone in several crucial areas where rural constituents set its priority. As lawmakers are back in DC, it's time for you to urge them to complete their unfinished pro-rural legislation quickly!

1. Comprehensive Energy Legislation

  • Filibustered in the Senate since November 2003. (H.R. 6)
  • Provides an incentives program for alternative vehicle and alternative fuels.
  • Encourages construction of Alaska natural gas pipeline.
  • All of the tax title portions of the energy bill are attached to the JOBS bill, including nearly $14 billion in tax incentives.

    ----- With skyrocketing gasoline prices, Congress should pass a comprehensive energy policy that expands the use of renewable energy and domestic supplies of oil and natural gas.

2. Corporate Tax Bill (JOBS Bill)

  • Passed both the House and Senate in different forms (S. 1637 / H.R. 4520) and awaits the House-Senate Conference reconciliation.
  • Provides an income tax credit and excise credit for biodiesel fuel mixtures.
  • Provides a production tax credit for electricity generated from agricultural animal waste.

    ---- Many industry and policy experts view passage of the corporate tax bill as the best vehicle to get renewable energy tax incentives.

3. Critical Habitat Reform Act

  • Passed the House Resources Committee. (H.R. 2933)
  • Requires the process for designating critical habitat to be practicable, economically feasible, and concurrent with the approval of a recovery plan for a species.

4. Sound Science for Endangered Species Act Planning Act

  • Passed the House Resources Committee. (H.R. 1662)
  • Requires "peer review" in determining that a species is an endangered or threatened species.

5. Death Tax Repeal Permanency Act

  • Passed the House. (H.R. 8)
  • Makes the repeal of estate tax permanent.

    ---- The House has repeatedly passed permanent death-tax-repeal legislation but the Senate does not even bring it to a vote.

6. Milk Import Tariff Equity Act

  • Referred to the House Trade Subcommittee. (H.R. 1160) / Referred to the Senate Finance Committee. (S. 560)
  • Imposes tariff-rate quotas on certain casein and milk protein concentrates.

7. National Dairy Equity Act

  • Referred to the House Subcommittee on Department Operations, Oversight, Nutrition and Forestry. (H.R. 4597) / Referred to the Senate Subcommittee on Department Operations, Oversight, Nutrition and Forestry. (S. 2525)
  • Establishes regional dairy marketing areas to stabilize the price of milk and support the income of dairy producers.

8. Universal Service Equity Act

  • Referred to the House Subcommittee on Telecommunications and the Internet. (H.R. 1582 Universal Service Fairness Act) / Referred to the Senate Committee on Commerce, Science, and Transportation. (S. 1380, Rural Universal Service Equity Act)
  • Distributes universal service support equitably throughout rural America.

9. Carl D. Perkins Vocational and Technical Education Act (Perkins Act)

  • Passed the House Committee on Education and the Workforce. (H.R. 4496, Vocational and Technical Education for the Future Act) / Referred to the Senate Committee on Health, Education, Labor, and Pensions. (S. 2686, Carl D. Perkins Career and Technical Education Improvement Act) · Reauthorizes the Carl D. Perkins Vocational and Technical Education Act of 1998.
